  • Question: What does a Canada Work Visa mean?

    Answer: It is an important piece of document, that also goes by the name – work permit Canada. This document is issued by the government of Canada, allowing a foreigner, such as a US citizen, to temporarily, but legally live and work in the country for a certain period of time.

  • Question: Do all foreigners require a Work Permit Canada?

    Answer: No. Subject to certain conditions, there are some people who don’t need, or are exempt from possessing a Work Visa in Canada (subject to some specific conditions):
    Military Personnel
    Foreign Diplomats
    Clergy
    Artists
    Athletes
    Ship or Truck Personnel
    Performing Artists (only under some specific circumstances)
    Designated Foreign Sellers and Buyers
    Remarque : You will find other exemptions regarding the same, listed in the Canadian Immigration Regulations.

  • Question: If I keep working in Canada for a considerable period of time, will I be able to get a Permanent Resident status?

    Answer: It is possible. If you work there for at least 2 years under a valid Work Permit, you might get yourself eligible for PR status under a Provincial Nominee Program or the Canadian Experience Class, depending upon your language proficiency and your job classification.

  • Question: What should I do to get a Canada Work Visa & How can I get a Work Permit issued to me in Canada?

    Answer: Generally speaking, there are 2 steps to the procedure for obtaining a Work Visa in Canada. And, here they are:

GET AN LMIA (LABOUR MARKET IMPACT ASSESSMENT) LETTER

FROM THE ESDC (EMPLOYMENT AND SOCIAL DEVELOPMENT CANADA) DEPARTMENT

In most cases, before you apply for a Work Visa in Canada, you will need to obtain an LMIA (Labor Market Impact Assessment) from the Employment and Social Development Canada department.
To get a Labor Market Impact Assessment from Service Canada, the prospective Canadian employer would have to first apply for the approval of the employment offer to the said foreign worker. For ESDC to issue such LMIA confirmation or approval is possible only when they ascertain that
Either there are no Canadian permanent residents or citizens who qualify for and are willing to fill this job position;
Or, the said foreign worker will take the responsibility of training Canadians during the time of their employment in Canada.
The prospective employer will have to demonstrate their sincere efforts, even though unsuccessful, in trying to recruit a Canadian permanent resident or citizen for the job position, to the ESDC. These efforts by the Canadian employer will often need to include advertising for the said job position.

Only if and when the ESDC is satisfied with the efforts put in by the prospective employer in order to hire a local worker, will they confirm or approve the offer of employment for the said job position to the foreign worker, and further issue them an LMIA letter.

Once the ESDC has issued the LMIA, the foreign worker will get invited to apply for a Canadian Work Permit or a Work Visa at a Canadian Embassy, High Commission, or Consulate outside of Canada. In certain cases, the person might be required to be interviewed by a visa officer.If the visa officer seems satisfied that employing this foreign worker will, in no way, have an adverse effect on the employment scene for Canadians in the country, and that this person qualifies for the said job position – only then will a Canada Work Permit be issued to the foreign worker.

Remarque : Sometimes, applicants from some specific countries are required to go through medical examinations.

Exemptions from Service Canada LMIA Applications

Not everyone requires an LMIA to apply for a Canadian Work Permit Visa.

There are some occupations which don’t need the ESDC to give them an LMIA. Some of these occupations are:
Foreign Students who hold a Canadian Study Permit
Agreement (NAFTA). It’s a category for the US as well as Mexican Citizens
US Citizens who hold jobs falling under the North American Free Trade
Spouses of Students, Workers, Canadian permanent residents, as well as who qualify under the Spousal Pilot Project
